If the parties then decide that they do not really want to participate in the mediation, the procedure will not be started.<\/strong>\u00a0The mediator will issue a certificate that the parties have appeared but did not wish to take advantage of the mediation. This is a good way to give the parties correct information about the mediation and to give them confidence that they will be persuaded to participate voluntarily. If this does not happen, there will be no mediation, so the principle of voluntariness is preserved. Unfortunately, the mandatory element in the law is ambiguous, and mediators sometimes follow through even with great resistance.
